Appeals Court To Hear Health Law Challenge

LINDA WERTHEIMER, host:

Medicaid is just one battleground in the fight over health care programs. The health care overhaul bill, which President Obama signed into law last year, requires people to obtain health insurance by 2014, or pay a penalty. The law has come under repeated legal challenge with some courts upholding it and others ruling against it.

In one ruling last January, a Florida judge struck down large portions of the legislation.

Now, this closely watched case goes to the 11th Circuit Court of Appeals in Atlanta. Starting tomorrow, a three-judge panel will hear from government lawyers who say the law should stand, while lawyers representing 26 states will argue it's unconstitutional.

As these cases play out, many legal scholars expect the health care overhaul law to wind up in the Supreme Court.
